What is Bank Fraud in Orange County?

According to U.S.C. 18 Part I, Chapter 63 § 1344, bank fraud is a federal crime that has implications far more severe than a state offense. The charge involves allegedly defrauding a bank for the defendant's personal gain. This can involve anything from false pretenses to fraudulent representations to empty promises. In order to prove guilt in a question of bank fraud, the prosecution will need to show that you:

  1. Knowingly executed or attempted to execute a scheme or artifice to defraud
  2. Did indeed defraud or attempt to defraud the bank
  3. Used a material misrepresentation or concealment of a material fact as part of the scheme or attempted scheme
