Elder Abuse

PC 368: Elder abuse is not only the physical abuse of elders, but financial abuse, neglect and endangerment and emotional abuse of the elderly. It’s important to note that crimes against disabled people are covered under this law.

Embezzlement

Embezzlement used to be a crime in and of itself, but it now falls under California's theft law, which means if you face embezzlement charges depending on your case you could face petty theft or grand theft charges, among other charges.

Extortion

Penal Code 518: "Extortion is the obtaining of property from another, with his consent, or the obtaining of an official act of a public officer, induced by a wrongful use of force or fear, or under color of official right."

False Imprisonment

Penal Code 236: False imprisonment is unlawfully detaining a person on the street, or forcing a person to move one place to another.

Forgery

Penal Code 470: Forgery is when, "Every person who, with the intent to defraud, knowing that he or she has no authority to do so, signs the name of another person or of a fictitious person" to documents.

Grand Theft Auto

Penal Code 487(d)(1): Grand theft auto is when you steal a car and intended to keep it for yourself and deprive the owner of his/her vehicle.

Hit and Run

California Vehicle Code 20002: Misdemeanor Hit and Run. If you're involved in an accident and leave the scene of an accident after allegedly damaging somebody else's car or property you could be charged with misdemeanor hit and run.

California Penal Code 1377: Civil Remedy. A civil remedy is a compromise that allows the victim who has been injured as the result of another's misdemeanor conduct a financial settlement. If the judge allows this the criminal charge of misdemeanor hit and run will be dismissed once the person is fully reimbursed for the damaged property.

California Vehicle Code 20001: Felony Hit and Run Involving Injury or Death. If you're involved in a hit and run accident that resulted in an injury or death and you don't stop and provide your information, and provide reasonable assistance to anyone requiring medical attention you could be charged with a felony.

Indecent Exposure

Penal Code 314: Indecent exposure prohibits publicly exposing your naked body or genitals with lewd intent.

Kidnapping

Penal Code 207: Kidnapping is the use of force or fear to take a person and move that person a "substantial distance."

Lewd Acts

Penal Code 647a: The crime of a lewd act is when you solicit anyone to engage in or engage in lewd conduct in any public place or in any place open to the public.

Lewd Acts with Minor

Penal Code 288: This is a much more serious crime than the Lewd Acts crime described above as this is considered to be child molestation. This crime is when a person willfully touched any part of a child's body or willfully caused a child to touch his/her own body for the purpose of sexual arousal.

Marijuana

California Health and Safety Code 11358: Cultivation of Marijuana. "Every person who plants, cultivates, harvests, dries, or processes any marijuana or any part thereof, except as otherwise provided by law, shall be punished by imprisonment in the state prison."

California Health and Safety Code 11360: Selling Marijuana. It's a felony to sell, give away or transport marijuana. In fact, marijuana sales law are so strict merely offering to sell, give away or transport marijuana is considered illegal, even though no money or pot exchanged hands.

Medi-Cal Fraud

California Welfare and Institutions Code 14017: Medi-Cal fraud refers to intentional attempts to receive unauthorized payments or benefits from the Medi-Cal program.

Murder

Penal Code 187: The crime of murder is the unlawful killing of a human being or a fetus with malice aforethought. Though the law may sound straightforward they're several defense options available.

Possession of a Controlled Substance

California Health and Safety Code 11350: Possession of a controlled substance prohibits possessing specific "controlled substances," such a common street drugs, and prohibits possessing legal drugs without a valid prescription.

Possession of Drug Paraphernalia

California Health and Safety Code 11364: "Possession of drug paraphernalia [is] an opium pipe or any device, contrivance, instrument, or paraphernalia used for unlawfully injecting or smoking a controlled substance."

Possession of Meth

California Health and Safety Code (HSC) 11377: HSC 11377 states, "unless upon the prescription of a physician, dentist, podiatrist, or veterinarian, licensed to practice in this state," possession of methamphetamines without a valid prescription is illegal.
