Need to Beat a DUI DMV Hearing? Expert Orange County DUI Attorney at Law Offices of Michael L. Guisti Can Help.

If you or someone you know were arrested for DUI in Orange County the DMV will IMMEDIATELY seek to suspend your driver’s license, but our experienced Orange County DUI defense lawyer can help you keep your license.

The Process of Orange County DUI DMV Hearing

After being arrested for alleged DUI the arresting Orange County officer will take your license and give you pink "Notice of Suspension" that acts as a temporary license that expires in 30 days.

Despite your temporary license expiring in only 30 days you only have ten days from the time of your arrest to call the DMV for a hearing on your driver’s license. Once the DMV hearing is requested, any current suspension is automatically delayed pending the outcome of the hearing.

The DUI DMV Hearing

A tape recorded hearing will take place at the Irvine driver’s safety office and will focus only on three issues. The first, did the Orange County officer have reasonable cause to believe the you were driving a vehicle; the second, did the Orange County officer lawfully and legally arrest you for; and third, were you driving a vehicle with a BAC of 0.08%?

Much like a court trial Orange County DUI defense attorneys at Law Offices of Michael Guisti will challenge your alleged BAC level at the time of driving along with examining potential problems by Orange County police.

Our Orange County criminal lawyer will call witnesses at the DMV hearing, including the arresting officer and a BAC expert.

What happens at your DMV hearing can affect your court case. If you have a favorable outcome this could possibly allow the Orange County prosecutor to offer you a lesser charge.

The Outcome of DUI DMV Hearing

If the DMV rules in your favor your license is reinstating.

Now if the DMV rules against you your license will be restricted for four months (longer if you have prior DUIs), however after the first full month of the suspension you can get the suspension converted to a driver’s license restriction.

Under the restriction you may only drive to and from work, and an alcohol class, called AB541. To apply for the restricted license you must be enrolled in the AB541 class, show proof of insurance and pay a $125 reinstatement fee.

If you’re found not guilty in your DUI court trial the DMV must reissue any suspended license.

Much like your DUI court trial, don’t go at this alone.

Orange County criminal attorney and Orange County Drunk driving defense lawyers at Law Offices of Michael L. Guisti will work for you from delaying your hearing to calling expert witnesses and cross-examining Orange County police officers to give you all the best possible solutions for your DMV hearing.
