What does an Expungement Mean?

Expungement means that your record is sealed and that when you apply for most jobs or for housing, you don’t have to disclose that you have been convicted, arrested or charged. When a person is arrested, that person gets a criminal record. At a minimum, there is a record of an arrest. If the person is later convicted, then the person has a record of both an arrest and a conviction. These records follow the person over many years.

What an Expungement can do for you?

A clean criminal record is an asset, a very important asset. It can make a difference whether an applicant gets a particular job. Getting a criminal record expunged sometimes determines whether a person who already has a particular job can keep that job, or advance to a better job. Once expunged a person or company doing a background check through local authorities, Orange County Sheriff’s Department or through the FBI will receive a response that there is "no record." Additionally, after you expunge your criminal record, you are legally entitled to state that the arrest or conviction never happened.

When Can You File?

At least three years from the time you are off probation, parole or straight release from prison for a felony, and after all court costs and fines, restitution or community service has been paid or completed.

At least one year from the time you were convicted of a misdemeanor.

At least two years from the time that a grand jury failed to indict you and the jury’s report of “no bill” was returned.

Anytime after you were found not guilty or your case was dismissed and that information has been recorded in the court’s journal.

Does Everyone Qualify?

No. The prosecutor may object. It is up to the court to decide whether to grant an expungement. Although, it is our experience that majority of our clients served have been approved with their records dismissed. To learn more and see if you qualify, please call our office and schedule a visit.

Are Expunged Criminal Records Destroyed?

Expunged records are not destroyed. Rather, they are segregated, meaning they’re moved to special locations for expunged records. When ordinary record searches are made, records kept in these special locations are not accessed. Thus the results of this ordinary search will be a return of “No Record.”
