Evading a Police Officer Causing Injury or Death

Under California Vehicle Code 2800.3, the crime of evading an officer causing injury or death is when you lead police on a pursuit and do something that directly causes the injury or death of another person during the course of that police pursuit. Those injured or killed during a police pursuit must have been the result of "direct, natural, and probable consequence" of your actions. The injury must be classified as a serious bodily injury, or a serious impairment of a physical condition, and not merely cuts or bruises.

What Happens If I Am Convicted?

This crime is known as a "wobbler," meaning it can be charged either as a misdemeanor or felony.

Each charge has different penalties:

  • Misdemeanor Evading a Police Officer Causing Injury - If convicted of injuring another person as a misdemeanor, you face up to a year in a county jail and up to $10,000 in fines.
  • Felony Evading a Police Officer Causing Injury - If convicted of injuring another person as a felony you face between three to seven years in a state prison.
  • Felony Evading a Police Officer Causing Death - If convicted of evading an officer and killing another person, you face between four to ten years in a state prison.
  • Additional Penalties - Regardless of whether you are convicted on a felony or misdemeanor charge, if convicted you could have your vehicle impounded for 30 days, have your driver's license revoked for up to three years, and lose your right to own firearms.
  • Commercial Drivers - If convicted, you could lose your commercial driver's license.
  • Immigration Issues - This is considered a crime of moral turpitude, which could lead to deportation.
